Upon request, the SMRC reviews certain decisions made by the RMA in respect to the contents of a Statement of Principles, to not to issue a Statement of Principles, or to amend a Statement of Principles, or to not to carry out an investigation.
The SMRC does not have a general power of review with respect to any decision made by the RMA. There are no provisions within the MRCA which provide for further review by the SMRC of a decision of the RMA made under s 370CF(2) of the MRCA.
The SMRC consists of medical practitioners and medical scientists with at least 10 years’ experience, appointed as Councillors by the Minister and selected by the Convener of the SMRC for a particular Review Council (3-5 Councillors). Selection is on the basis of their expertise in the injury, disease or death relevant to the Statement of Principles subject to review. Each Review Council must have a councillor with at least 5 years’ experience in epidemiology. For a list of current councillors, see Our Members page.
The Registrar and Staff of the SMRC are employees of Department of Veterans’ Affairs.
